Welcome to **K's Closet & Custom Things** ("Company," "we," "us," or "our"). These Terms and Conditions of Use ("Terms") govern your access to and use of our website, located at **ksclosetandcustomthings.com** (the "Site"), and any purchases of our custom wreaths, floral arrangements, or handmade products (collectively, "Products"). By accessing the Site or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Site or purchase our Products.
1. Governing Law & Ohio Jurisdiction These Terms and all matters arising out of or relating to your purchase of Products shall be governed by, and construed in accordance with, the laws of the **State of Ohio**, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to these Terms or our Products must be instituted exclusively in the federal or state courts located in Hamilton County, Ohio. You hereby consent to the personal jurisdiction of such courts.
2. Custom Orders, Sourcing, & Substitutions Because our Products are individually handmade and often utilize seasonal or natural materials, the following terms apply to all orders:
Handmade Variance: You acknowledge that handmade items naturally vary. Minor differences in twig placement, ribbon folds, and flower arrangement compared to website photographs or design sketches are expected and do not constitute defects.
Material Substitutions: Wholesale availability for seasonal items (such as specific silk flowers, holiday ribbons, or unique greenery) can change rapidly. We reserve the right to substitute materials of equal or greater quality and aesthetic value without prior notice if the exact material is unavailable.
Design Approvals: For custom commissions, design details will be finalized via communication before production. Once you approve the final design layout or concept, no further structural changes can be made.
3. Pricing, Ohio Sales Tax, & Payments
Pricing: All prices are listed in U.S. Dollars (USD) and are subject to change without notice before an order is placed.
Ohio Sales Tax: In accordance with Ohio Department of Taxation regulations, sales tax will be calculated and collected on all orders shipped to an Ohio address or picked up locally, based on the destination or origin tax rate required by law.
Payment Terms: Full payment or a designated non-refundable deposit (specified at checkout) is required before we secure materials or begin production on custom orders.
4. Shipping, Local Pickup, & Risk of Loss
Shipping: We pack our wreaths securely to minimize movement. However, minor shifting of bows or leaves may occur during transit and can be easily fluffed by hand.
Risk of Loss: Title to and risk of loss for the Products pass to you upon our delivery of the package to the common carrier (e.g., USPS, UPS, FedEx). We are not liable for packages stolen after delivery verification by the carrier.
Local Pickup: If you select local pickup at checkout, items must be picked up within 5 days of notification. Items left uncollected after 10 days may be resold, and your payment will be forfeited.
5. Custom Order Cancellation & Return Policy
All Sales Final: Because custom wreaths are manufactured specifically to your individual specifications, all sales of custom Products are final. We do not accept returns or exchanges for buyer's remorse or incorrect size ordering.
Cancellations: You may cancel an order within 24 hours of placement for a full refund. Once material cutting, assembly, or specialized sourcing has begun, orders cannot be canceled or refunded.
Shipping Damage: If your Product arrives physically damaged by the carrier, you must report it to us at [customerservice@ksclosetandcustomthings.com] within 48 hours of delivery. You must provide clear photographic evidence of the damaged product and the original packaging to qualify for a repair, replacement, or store credit.
6. Product Care, Display, & Property Damage Waiver Proper care and installation of your wreath are vital to its longevity and your property's safety.
Weathering Disclaimer: Unless explicitly labeled for unrestricted outdoor use, wreaths are intended for indoor display or placement in a highly protected outdoor area (such as a deeply covered porch or behind a storm door). We are not responsible for damage caused by direct exposure to sun, rain, moisture, frost, wind, or pests.
Property Damage Waiver: To the maximum extent permitted under Ohio law, the Company shall not be liable for any direct, indirect, incidental, or consequential damage to your property resulting from the use or hanging of our Products. This includes, but is not limited to: * Scratches, gouges, dents, or paint peeling on doors, walls, siding, or trim caused by wreath wire, frames, over-the-door hangers, or product friction. * Staining or color bleeding onto surfaces from wet natural or dyed elements. Damage caused by fallen wreaths due to inadequate hooks, adhesives, or hanging hardware used by the customer.
7. Intellectual Property All content included on this Site—including but not limited to custom wreath design patterns, original photography, product descriptions, website text, graphics, and logos—is the exclusive intellectual property of the Company and is protected by United States copyright laws. You may not copy, reproduce, imitate, or distribute our designs or media without our express written consent.
8. Limitation of Liability To the fullest extent permitted by applicable Ohio law, the Company’s total liability for any claim arising out of or relating to your purchase or use of any Product shall not exceed the actual purchase price paid by you for that specific Product.
